Note on data transfer to the USA and other third countries

Among other things, we use tools from companies based in the USA or other third countries that are not secure under data protection law. If these tools are active, your personal data may be transferred to these third countries and processed there. We would like to point out that a level of data protection comparable to that in the EU cannot be guaranteed in these countries. For example, US companies are obliged to hand over personal data to security authorities without you as the data subject being able to take legal action against this. 5. Analysis tools and advertising

Google Tag Manager

We use the Google Tag Manager. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

Google Tag Manager is a tool that enables us to integrate tracking or statistical tools and other technologies on our website. Google Tag Manager itself does not create any user profiles, does not store any cookies and does not carry out any independent analyses. We have concluded an order processing contract with Google and fully implement the strict requirements of the German data protection authorities when using Google Analytics.

6. Newsletter

Newsletter data

If you would like to receive the newsletter offered on the website, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the e-mail address provided and that you agree to receive the newsletter. No further data is collected, or only on a voluntary basis. We use the newsletter service providers described below to process the newsletter.

MailChimp

This website uses the services of MailChimp to send newsletters. The provider is Rocket Science Group LLC, 675 Ponce De Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA.

MailChimp is a service that can be used to organise and analyse the sending of newsletters, among other things. If you enter data for the purpose of subscribing to the newsletter (e.g. email address), this data is stored on MailChimp’s servers in the USA.

With the help of MailChimp, we can analyse our newsletter campaigns. When you open an email sent with MailChimp, a file contained in the email (known as a web beacon) connects to MailChimp’s servers in the USA. This makes it possible to determine whether a newsletter message has been opened and which links, if any, have been clicked on. Technical information is also collected (e.g. time of access, IP address, browser type and operating system). This information cannot be assigned to the respective newsletter recipient. It is used exclusively for the statistical analysis of newsletter campaigns. The results of these analyses can be used to better adapt future newsletters to the interests of the recipients.

If you do not wish to be analysed by MailChimp, you must unsubscribe from the newsletter. For this purpose, we provide a corresponding link in every newsletter message.

Data processing is based on your consent (Art. 6 para. 1 lit. a DSGVO). You can revoke this consent at any time by unsubscribing from the newsletter. The legality of the data processing operations that have already taken place remains unaffected by the cancellation.

The data you provide us with for the purpose of subscribing to the newsletter will be stored by us or the newsletter service provider until you unsubscribe from the newsletter and deleted from the newsletter distribution list after you unsubscribe from the newsletter. Data stored by us for other purposes remains unaffected by this.

After you unsubscribe from the newsletter distribution list, your email address may be stored by us or the newsletter service provider in a blacklist if this is necessary to prevent future mailings. The data from the blacklist will only be used for this purpose and will not be merged with other data. This serves both your interest and our interest in complying with the legal requirements when sending newsletters (legitimate interest within the meaning of Art. 6 para. 1 lit. f DSGVO). Storage in the blacklist is not limited in time. You can object to the storage if your interests outweigh our legitimate interest.

7. Plugins und Tools

Google Maps

8. Own services

Handling of applicant data

We offer you the opportunity to apply to us (e.g. by e-mail, post or online application form). In the following, we inform you about the scope, purpose and use of your personal data collected as part of the application process. We assure you that your data will be collected, processed and used in accordance with applicable data protection law and all other statutory provisions and that your data will be treated in strict confidence.

Scope and purpose of data collection

If you send us an application, we will process your associated personal data (e.g. contact and communication data, application documents, notes taken during interviews, etc.) to the extent necessary to decide on the establishment of an employment relationship. The legal basis for this is Section 26 BDSG under German law (initiation of an employment relationship), Art. 6 para. 1 lit. b DSGVO (general contract initiation) and – if you have given your consent – Art. 6 para. 1 lit. a DSGVO. Consent can be revoked at any time. Your personal data will only be passed on within our company to persons who are involved in processing your application.

If the application is successful, the data submitted by you will be stored in our data processing systems on the basis of Section 26 BDSG and Art. 6 para. 1 lit. b DSGVO for the purpose of implementing the employment relationship.

Retention period of the data

If we are unable to make you a job offer, you reject a job offer or withdraw your application, we reserve the right to retain the data you have submitted on the basis of our legitimate interests (Art. 6 para. 1 lit. f DSGVO) for up to 6 months from the end of the application process (rejection or withdrawal of the application). The data will then be deleted and the physical application documents destroyed. The retention serves in particular as evidence in the event of a legal dispute. If it is evident that the data will be required after the 6-month period has expired (e.g. due to an impending or pending legal dispute), the data will only be deleted when the purpose for further storage no longer applies.

Longer storage may also take place if you have given your consent (Art. 6 para. 1 lit. a DSGVO) or if statutory retention obligations prevent deletion.

9. Our social media presence

Data processing through social networks

We maintain publicly accessible profiles on social networks. The individual social networks we use are listed below.
Social networks such as Facebook, Twitter etc. can generally analyse your user behaviour comprehensively when you visit their website or a website with integrated social media content (e.g. like buttons or advertising banners). Visiting our social media presences triggers numerous data protection-relevant processing operations. In detail:
If you are logged into your social media account and visit our social media presence, the operator of the social media portal can assign this visit to your user account. However, your personal data may also be collected if you are not logged in or do not have an account with the respective social media portal. In this case, this data is collected, for example, via cookies that are stored on your end device or by recording your IP address.
With the help of the data collected in this way, the operators of the social media portals can create user profiles in which your preferences and interests are stored. In this way, interest-based advertising can be displayed to you inside and outside the respective social media presence. Legal basis

Our social media presences are intended to ensure the widest possible presence on the internet. This is a legitimate interest within the meaning of Art. 6 para. 1 lit. f DSGVO. The analysis processes initiated by the social networks may be based on different legal bases, which must be specified by the operators of the social networks (e.g. consent within the meaning of Art. 6 para. 1 lit. a DSGVO).

Controller and assertion of rights

4. Purposes and legal bases of the processing

4. a) Purposes of the processing

Conducting telephone conferences, online meetings, video conferences and/or webinars (hereinafter: “online meetings”) with the help of external tools. The service providers of these tools are listed individually under point 5 “Recipients or categories of recipients of personal data” below.

If “online meetings” are recorded, we will inform you of this transparently in advance and – if necessary – ask for your consent. The fact of the recording will also be displayed to you in the app.

If it is necessary to log the results of an online meeting, we will log the chat content.

In the case of webinars, we will also process the questions asked by participants for the purpose of recording and follow-up.

The possibility of software-based “attention monitoring” (“attention tracking”) in “online meeting” tools such as “Zoom” is deactivated.

Automated decision-making within the meaning of Art. 22 DSGVO is not used.

4. b) Personal data that is the subject of processing

User data: First name, surname, display name (“Display Name”), telephone (optional), email address, password (if “Single-Sign-On” is not used), profile picture (optional), department (optional)

Meeting metadata: Topic, description (optional), participant IP addresses, device/hardware information, meeting ID, phone numbers, location

For recordings (optional): MP4 file of all video, audio and presentation recordings, M4A file of all audio recordings, text file of the online meeting chat.

When dialling in by telephone: details of the incoming and outgoing telephone number, country name, start and end time. If necessary, further connection data such as the IP address of the device can be saved.

Text, audio and video data: In an “online meeting”, you may have the opportunity to use the chat, question or survey functions. In this respect, the text entries you make are processed in order to display them in the “online meeting” and, if necessary, to log them. In order to enable the display of video and the playback of audio, the data from the microphone of your end device and from any video camera of the end device will be processed for the duration of the meeting. You can switch off or mute the camera or microphone yourself at any time via the “Zoom” applications.

To take part in an “online meeting” or to enter the “meeting room”, you must at least provide information about your name.

Please refer to the following table under point 5 “Recipients or categories of recipients of personal data” to find out which data is processed by which of the tools used.

4. c) Legal basis of the processing

For employees of Neuland Development GmbH & Co. KG, § 26 BDSG is the legal basis for data processing. If, in connection with the use of “Zoom”, data is not required for data processing, but is nevertheless an elementary component of the use of “Zoom”, Art. 6 para. 1 lit. f) DSGVO is the legal basis for data processing. In these cases, we are interested in the effective organisation of online meetings.

For other participants in “online meetings” – insofar as the meetings are held within the framework of contractual relationships – Art. 6 para. 1 lit. b) DSGVO is the legal basis for data processing.

If there is no contractual relationship, the legal basis is Art. 6 para. 1 lit. f) DSGVO. Here too, we have an interest in the effective organisation of online meetings.

5. Recipients or categories of recipients of the personal data

Employees of Neuland Development GmbH & Co. KG process personal data in connection with the organisation of online meetings. This data is not passed on to third parties unless it is intended to be passed on. Please note that content from “online meetings”, as with face-to-face meetings, is often used to communicate with customers, interested parties or third parties and is therefore intended to be passed on.

6. Datenverarbeitung außerhalb der Europäischen Union

Die Anbieter der Tools „Zoom“ (Zoom Video Communications), „Mural“ (Tactivos, Inc.) und Cisco (WEBEX) haben Ihren Sitz in den USA. Eine Verarbeitung der personenbezogenen Daten findet damit auch in einem Drittland statt. Wir haben mit den Anbietern von Zoom, Microsoft, GotoMeeting, einen Auftragsverarbeitungsvertrag geschlossen, der den Anforderungen von Art. 28 DSGVO entspricht.

Ein angemessenes Datenschutzniveau ist bei den Anbietern „Zoom“, „Mural“ und „WEBEX“ durch die Anwendung der sog. EU-Standardvertragsklauseln garantiert.

8. Rights of data subjects

According to the General Data Protection Regulation, you have the following rights:

You have the right to obtain information about the personal data stored about you (Art. 15 DSGVO).

If incorrect personal data is processed, you have the right to rectification (Art. 16 DSGVO).

If the legal requirements are met, you can request the erasure or restriction of processing (Art. 17 and 18 DSGVO).

For reasons arising from your particular situation, you may object to the processing of personal data concerning you by Neuland Development GmbH & Co. KG (Art. 21 DSGVO). If the legal requirements are met, no further processing of your personal data by Neuland Development GmbH & Co. KG.

If you have consented to the data processing or a contract for data processing exists and the data processing is carried out using automated procedures, you may have a right to data portability (Art. 20 DSGVO).

Since you have consented to the processing by means of a corresponding declaration, you can revoke your consent at any time for the future. The legality of the data processing carried out on the basis of the consent until the revocation is not affected by this.
